General Terms and Conditions for using TR3ZOR’s Platform
General
This agreement on general terms and conditions (thereafter “Agreement”) governs the use of (including any access to) our websites and apps (thereafter Platform). By clicking or tapping any button or box marked “accept” or “agree” (or a similar term) in connection with this Agreement, or by accessing or using the Platform or the Services (as defined below), the user agrees to be bound by this Agreement which may be modified from time to time at our sole discretion and in accordance with this Agreement. The English version of this Agreement prevails on any version of this Agreement in other languages.
An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Definitions
Platform is a user-interface that provides access to a global blockchain-based database of lost and stolen items.
User account is a part of the Platform designated to a specific user to use the Services.
Virtual currency refers to Ethereum (ETH), Bitcoin (BTC) or TR3token (TR3). We may, from time to time and in our sole discretion, add and remove certain Virtual currencies.
Registration and creating a user account.
Only registered users, who have accepted the Agreement, may use the Services offered by the Platform. Upon registration, the user is granted access to his or her user account. Information collected upon registration is processed in accordance with the TR3ZOR’s Privacy policy and other data related policies. By agreeing to be bound by this Agreement, the user acknowledges and agrees that he or she has read, understood and agreed with these policies.
The user shall register on the Platform by filling in a registration form. Thereafter, a user account is created on the Platform. The user must fulfil the following criteria throughout the use of the Platform: He or she must be a physical individual (legal entities have to apply via email) and provide a valid e-mail and residential address and choose a password. He or she must be at least 18 years of age, be fully legally capacitated, not be subject to insolvency procedures, and not have limited legal capacity due to disorders of a mental nature, and during the registration process, not be under the influence of alcohol, drugs, psychoactive, toxic or other intoxicating substances. TR3ZOR has the right to refuse registration of any person on the Platform without giving any reason.
Users are required to inform TR3ZOR immediately about any changes to their personal information. If the user loses access to the email inbox, TR3ZOR may not guarantee password recovery.
The user account is private, and only the owner of the user account is authorized to enter and use it. The user may not create more than one user account on the Platform. He or she is liable for all activities conducted through the user account, whether or not authorized by him or her. Using user accounts for malicious activities will result in immediate termination of those user accounts. Users are obliged to keep their passwords secret and to change them immediately if there is a certain probability that third parties could have access to them.
TR3ZOR is not responsible for any loss or compromise of the user’s access information and/or personal information or any loss the user may incur as a result of compromise of the access Information and/or personal Information.
The user may terminate the use of the Platform and the service at any time. TR3ZOR reserves the right to terminate any user account without prior notice.
Specifics of the Services
The user is responsible for all activities under the user account and for securing the user account (passwords, access verification details, hints, or any other codes that are used to access the user account or services) against unauthorized access.
The user specifically acknowledges and confirms that as a result of using the services he or she enters into a smart-contract that, without further notice, TR3ZOR may transfer, use and/or alienate any amount of virtual currencies at the respective user account. The user acknowledges that with respect to virtual currencies pursuant to this paragraph, he or she might not be able to exercise certain rights of ownership.
TR3ZOR may receive compensation/income in connection with using/transferring/alienating virtual currencies including rewards in its business to which the user has no claim or entitlement. TR3ZOR and third-party providers may experience cyber-attacks, extreme market conditions, or other operational or technical difficulties which could result in the delay or immediate halt of provision of services either temporarily or permanently. Provided that TR3ZOR has taken reasonable commercial and operational measures to prevent such occurrences in its technical systems, TR3ZOR shall not be responsible or liable for any loss or damage of any kind suffered by the user as a result of such cyber-attacks, operational or technical difficulties or suspensions/delays of transactions. No transaction with Virtual currency will be deemed settled and completed until the blockchain transaction is confirmed to the relevant address. Changes in laws or regulations or action at the state and/or government level may adversely affect the use, transfer, exchange, and value of virtual currencies. Transactions in Virtual currencies may be irreversible and, accordingly, losses due to fraudulent or accidental transactions may not be recoverable. Virtual currencies markets are extremely volatile. Any user account maintained by TR3ZOR may not be sufficient to cover all losses incurred by the user. In view of these risks, which are just some of the risks associated with using the services and holding or using virtual currencies, and do not constitute an exhaustive list of such risks, the user should carefully consider whether holding or using Virtual currencies in general and/or using TR3ZOR’s services is suitable for him or her.
Representations and warranties of the user
The user represents, warrants and agrees that he or she will not infringe or violate the intellectual property rights or any other rights of others (including those of TR3ZOR); violate any law or regulation, including, without limitation, any applicable export control and currency control laws; decipher, decompile, disassemble, modify, translate, reverse engineer or otherwise attempt to derive source code, algorithms, tags, specifications, architectures, structures or other elements of the Platform, in whole or in part; use any of the Services for the benefit of anyone other than user, including selling, reselling, distributing, hosting, leasing, renting, licensing or sublicensing, in whole or in part, any of the services, for hosting or time-sharing services, or as part of a service bureau or outsourcing offering; provide any services to any third party using the Platform.
Collection and Use of Location Data:
Tr3zor App uses your location data to provide location-based features such as showing nearby lost, stolen, and found items, as well as facilitating claim bounty events. We understand the importance of your privacy, and we want to assure you that your location data is handled with care.
*Why do we collect location data?
Tr3zor App collects your location data to enhance your experience by providing relevant information about lost, stolen, and found items in your vicinity. This data is crucial for the proper functioning of the app’s features.
*How is your location data used?
Your location data is used exclusively within the Tr3zor App to display nearby items and facilitate claim bounty events. We do not share this information with third parties, and it is not used for undisclosed, unimplemented, or disallowed purposes.
*Security of your location data:
We take the security of your location data seriously. It is stored securely and will not be shared with anyone outside the Tr3zor App. We employ industry-standard measures to protect against unauthorized access or disclosure of your location information.
*User Control:
You have control over the app’s access to your location data. You can adjust your device’s location settings to grant or deny access. The app will only collect location data when you provide consent.
Background Location Explanation:
In addition to the Collection and Use of Location Data, Tr3zor App utilizes background location services to enhance your experience further. Background location services allow the app to access your device’s location even when the app is not actively in use. In order to provide you with a seamless and efficient experience, Tr3zor App utilizes background location services specifically for Bounty Events. These events are designed to notify you when you are within the proximity of an area where a bounty is active, ensuring that you stay informed about opportunities to claim rewards.
Prominent Disclosure:
Before accessing your device’s location runtime permission, we will provide you with a prominent disclosure. This disclosure will include, but is not limited to, the following statement: Tr3zor app collects location data background and foreground to enable features such as showing nearby lost, stolen, and found items, as well as supporting bounty claim events, while app is in use. We understand the importance of clarity, and additional details regarding how and why we use location data will be readily visible to users.
Third-Party Websites or Services
TR3ZOR’s services may include links or references to other websites or services (third-party websites) solely as a convenience to users. TR3ZOR does not endorse any such third-party websites or the information, materials, products, or services contained on or accessible through them. In addition, user correspondence or business dealings with or participation in promotions of advertisers found on any of TR3ZOR’s services are solely between the user and such advertiser. Access and use of third-party websites, including the information, materials, products, and services on or available through third-party websites are solely at the user’s own risk.
Applicable law
Estonian and European law applies to this agreement. The place of jurisdiction is the registered office of the company in Estonia.
